Terms of service

These terms are an agreement between Trakinit (“we”, “us”) and the business that creates a Trakinit account (“you”). By creating an account or using Trakinit, you agree to them on behalf of that business. If you don’t agree, don’t use the service.

The service

Trakinit is business software for marketing attribution. It collects marketing touchpoints from your website, ad accounts and other sources, matches them to sales from the platforms you connect, and reports which channels produced revenue. It is offered to businesses only, not to consumers for personal use.

Your account

• You must give accurate account information and keep your login credentials secure.
• You are responsible for everything done under your account, including by team members you invite.
• Tell us at support@trakinit.com if you believe your account has been accessed without permission.

Free trial, subscriptions and billing

• New workspaces start with a 14-day free trial. No charge is made during the trial.
• Paid plans are monthly subscriptions: Starter at $299, Growth at $599, Enterprise at $1,499 per month, plus any applicable taxes. Promotional prices apply only for the period stated in the offer.
• Subscriptions renew automatically each month and are charged to your payment method on file through our payment processor, Stripe, until you cancel.
• If a payment fails, we retry it and may suspend access to reports until the balance is paid.
• We may change prices with at least 30 days’ notice. A change takes effect at your next renewal after the notice period.
• Cancellations and refunds are covered by our refund and cancellation policy.

Your data

You own the data you send to Trakinit, including touchpoints, sales, spend and customer information (“your data”). You give us permission to process your data only to provide, secure and improve the service for you, as described in our privacy policy. We don’t sell your data.

You are responsible for having the rights and legal basis to send us your data, including giving any notices to and getting any consents from your own website visitors and customers that the laws that apply to you require.

Acceptable use

You agree not to:

• use Trakinit in violation of any law, including privacy, consumer protection and anti-spam laws;
• send us sensitive personal data, such as health, financial account or government ID information, or data about children under 16;
• try to access other customers’ data, probe or disrupt the service, or get around usage limits or security controls;
• resell or sublicense the service, or use it to build a competing product.

We may suspend accounts that break these rules or put the service or other customers at risk.

Third-party services

Trakinit connects to services you choose, such as Shopify, Amazon, Meta and Slack. Your use of those services is governed by their own terms. We aren’t responsible for their availability or for changes they make to their data or APIs.

Our property

We own Trakinit, including its software, design and documentation. We grant you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes while your account is in good standing. If you send us feedback, we may use it without obligation to you.

Availability and changes

We work to keep Trakinit available and accurate, and post the current status at trakinit.com/status, but we don’t guarantee uninterrupted service. We may add, change or remove features. If we remove a feature you rely on, you may cancel under our refund policy.

Disclaimers

Attribution results are estimates based on the data available, and each match includes a confidence score. Use them as one input to your business decisions. Except as stated in these terms, the service is provided “as is”, without warranties of any kind, to the extent the law allows.

Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim arose.

Indemnity

You agree to defend and indemnify us against third-party claims arising from your data or your use of the service in violation of these terms or the law.

Ending the agreement

You may cancel at any time in Settings. We may end or suspend your account for a material breach of these terms. When a workspace closes, you have 29 days to export your data or resubscribe. After that, we delete the workspace and its data automatically, as described in the privacy policy.

Changes to these terms

We may update these terms. For material changes, we notify account admins by email or in the app at least 30 days before they take effect. Continuing to use Trakinit after that date means you accept the new terms.

Governing law

These terms are governed by the laws of the United States and of the state in which Trakinit is organized, without regard to conflict-of-law rules.
